Terms of Service
These Terms of Service ("Terms") govern your use of the Lune language learning mobile application ("App"), which is owned and operated by Lune Digital LLC ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy.
1. Use of the App
a. Eligibility: You must be at least 13 years old to use the App. If you are between 13 and 18 years old, you must have your parent or guardian’s permission to use the App.
b. License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial language learning purposes.
c. Restrictions: You may not use the App for any illegal or unauthorized purpose. You agree not to copy, modify, distribute, sell, or lease any part of our App, nor may you reverse engineer or attempt to extract the source code, unless laws prohibit these restrictions.
2. Accounts
a. Account Creation: To access certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
b. Account Responsibility: You are responsible for safeguarding your account password and for any activities or actions under your account, whether your password is with our App or a third-party service.
3. Content
a. User-Generated Content: You may post, link, store, or otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post on or through the App, including its legality, reliability, and appropriateness.
b. Content Ownership: You retain all rights to any Content you submit, post, or display on or through the App and you are responsible for protecting those rights.
4. Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
5. Indemnification
You agree to defend, indemnify, and hold harmless Lune Digital LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; or b) a breach of these Terms.
6. Limitation of Liability
In no event shall Lune Digital LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
